GUNTECH TERMS OF USE

Guntech App End User License Agreement

Please read this End User License Agreement ("EULA") carefully before clicking the "I Agree" button, downloading, or using the Guntech app ("Application").

By clicking the "I Agree" button, downloading, or using the Application, you agree to be bound by the terms and conditions of this EULA.

If you do not agree to the terms of this EULA, do not click "I Agree," and do not download or use the Application.

1. Parties

This EULA is a legal agreement between you ("End User" or "you") and Utopos Games, Inc. ("Company," "we," or "us"), governing your use of the Guntech application ("Application"), which includes all related documentation and updates provided by the Company.

2. Privacy

The Company respects your privacy. Please refer to our Privacy Policy at https://www.utoposgames.com/privacy-policy for information on how we collect, use, and disclose your personal information. By using the Application, you agree to the terms of our Privacy Policy.

3. Limited License

The Company grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application solely for your personal, non-commercial purposes strictly in accordance with the terms of this EULA.

You shall not:

  • Copy, modify, or distribute the Application or any portion thereof.
  • Reverse engineer, disassemble, or decompile the Application.
  • Make the Application available over a network or other environment permitting access or use by multiple devices or users at the same time.
  • Use the Application for creating a product, service, or software that is, directly or indirectly, competitive with or in any way a substitute for the Application.
  • Use the Application to send automated queries to any website or to send any unsolicited commercial email.
  • Use any proprietary information or any of the Company's interfaces or other intellectual property in the design, development, manufacture, licensing, or distribution of any applications, accessories, or devices for use with the Application.

4. Age Restrictions

By using the Application, you represent that you are at least 13 years of age. If you are under 13 years of age, you may not use the Application. If you are between the ages of 13 and 18, you may only use the Application with the consent of a parent or legal guardian who agrees to be bound by this EULA.

5. Objectionable Content Policy

Content within the Application must not be objectionable, offensive, or harmful. The Company reserves the right to remove any content that violates this policy. Users may report objectionable content to the Company at contact@utoposgames.com, and the Company will act on such reports within 24 hours by removing the content and ejecting the user who provided the objectionable content.

6. Warranty

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APPLICATION.

7. Maintenance and Support

The Company may, at its sole discretion, provide maintenance and support for the Application. The Company is not obligated to provide any maintenance or support services for the Application. Any maintenance or support provided is subject to the terms of this EULA.

8. Product Claims

The Company is responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of the Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

9. Third Party Intellectual Property Claims

The Company shall not be responsible for the investigation, defense, settlement, or discharge of any intellectual property infringement claim brought by a third party. However, in the event of such a claim, the Company will cooperate with you to the extent necessary to resolve the matter.
